Some research is too risky to be conducted on anyone whose life expectancy is more than a few hours. Yet sometimes, the research can still be carried out using subjects who are brain dead or are soon to undergo a terminal wean, and who have articulated values that inclusion in the study can honor. So argues a team of ethicists and researchers at M.D. Anderson Cancer Center, where such research was recently undertaken.

For many Americans, the election of Barack Obama as the country's first black president signaled that we had become a post-racial nation - some even suggested that race was no longer worth discussing. Of course, the evidence tells a very different story. And while social scientists are fully engaged in examining the facts of race, normative political thought has failed to grapple with race as an interesting moral case or as a focus in the expansive theory of social justice. Political (...) thought's under participation in the debate over the status of blacks in American society raises serious concerns since the main academic task of political theory is to adjudicate discrepancies between the demands of ideal justice and social realities. Christopher J. Lebron contends that it is the duty of political thought to address the moral problems that attend racial inequality and to make those problems salient to a democratic polity. Thus, in The Color of Our Shame, he asks two major questions. First, given the success of the Civil Rights Act and the sharp decline in overt racist norms, how can we explain the persistence of systemic racial inequality? Second, once we have settled on an explanation, what might political philosophy have to offer in terms of a solution? In order to answer these questions Lebron suggests that we reconceive of racial inequality as a condition that marks the normative status of black citizens in the eyes of the nation. He argues that our collective response to racial inequality ought to be shame. While we reject race as a reason for marginalizing blacks on the basis of liberal democratic ideals, we fail to live up to those ideals - a situation that Lebron sees as a failure of national character. Drawing on a wide array of resources including liberal theory, virtue ethics, history, and popular culture, Lebron proposes a move toward a "perfectionist politics" that would compel a higher level of racially relevant moral excellence from individuals and institutions and enable America to meet the democratic ideals that it has set for itself. This paper examines three accounts of the sleeping beauty case: an account proposed by Adam Elga, an account proposed by David Lewis, and a third account defended in this paper. It provides two reasons for preferring the third account. First, this account does a good job of capturing the temporal continuity of our beliefs, while the accounts favored by Elga and Lewis do not. Second, Elga’s and Lewis’ treatments of the sleeping beauty case lead to highly counterintuitive consequences. The proposed (...) account also leads to counterintuitive consequences, but they’re not as bad as those of Elga’s account, and no worse than those of Lewis’ account. (shrink)

This book offers a novel defence of a highly contested philosophical position: biological natural kind essentialism. This theory is routinely and explicitly rejected for its purported inability to be explicated in the context of contemporary biological science, and its supposed incompatibility with the process and progress of evolution by natural selection. Christopher J. Austin challenges these objections, and in conjunction with contemporary scientific advancements within the field of evolutionary-developmental biology, the book utilises a contemporary neo-Aristotelian metaphysics of "dispositional properties", (...) or causal powers, to provide a theory of essentialism centred on the developmental architecture of organisms and its role in the evolutionary process. What role should a citizen's religious convictions play in her political activities? Is she, for example, permitted to decide on the basis of her religious convictions to support laws that criminalize abortion or discourage homosexual relations? Christopher Eberle is deeply at odds with the dominant orthodoxy among political theorists about the relation of religion and politics. His argument is that a citizen may responsibly ground her political commitments on religious beliefs, even if her only reasons for her political commitments (...) are religious in nature. His ideal of citizenship allows citizens to engage in politics without privatizing their religious commitments, and yet does not license mindless and intransigent sectarianism. An inherently controversial book that offers a substantial challenge to political liberalism, it will be read by students and professionals in philosophy, political science, law and religious studies, and general readers seeking insight into the relationship between religious commitments and liberal politics. This chapter examines a key focal characteristic of the Scottish Enlightenment, namely, its delineation of how a ‘science of man’ can inform and structure an account of ‘society’. The key contribution of the Scots to the rise of the human sciences lies in a conception of society as a set of interlocked institutions and behaviours. The Scots provided an analysis of both social statics and social dynamics, which shifted the focus away from the individualism that characterized early modern jurisprudence. Humans (...) as social beings are best understood in society and not as monadic individuals. The Scottish analysis also sidelined the centrality traditionally allotted to the political. Humans are social as well as political animals. Political institutions are simply one kind of institution among several, to be given no greater priority than the rest. (shrink)

There is a widely acknowledged, albeit still imprecisely defined, connection between the ‘calculatory’ analyses of local motion developed within the fourteenth century ‘Merton School’ and Galileo Galilei's later treatment of natural motion. The present essay is intended to cast some light on the possible sources and significance of Galileo's putative familiarity with the medieval discussions through a study of the fortunes of the most typical representative of the School, Richard Swineshead. Particular attention is paid to the writings of such scholastic (...) philosophers of Galileo's day as Francisco Toledo, Francesco Piccolomini, Iacopo Zabarella, Francesco Buonamico and Scipione Chiaramonte. Somewhat unexpectedly, it emerges that such authors possessed only the most fragmentary and attenuated knowledge of Swineshead's ideas. The implications of this circumstance, especially insofar as it renders Galileo's familiarity with the Merton tradition even more problematical, are discussed briefly. (shrink)

This paper examines the debate between permissive and impermissive forms of Bayesianism. It briefly discusses some considerations that might be offered by both sides of the debate, and then replies to some new arguments in favor of impermissivism offered by Roger White. First, it argues that White’s (Oxford studies in epistemology, vol 3. Oxford University Press, Oxford, pp 161–186, 2010) defense of Indifference Principles is unsuccessful. Second, it contends that White’s (Philos Perspect 19:445–459, 2005) arguments against permissive views do not (...) succeed. (shrink)

An adequate account of laws should satisfy at least five desiderata: it should provide a unified account of laws and chances, it should yield plausible relations between laws and chances, it should vindicate numerical chance assignments, it should accommodate dynamical and non-dynamical chances, and it should accommodate a plausible range of nomic possibilities. No extant account of laws satisfies these desiderata. This paper presents a non-Humean account of laws, the Nomic Likelihood Account, that does.

Deference principles are principles that describe when, and to what extent, it’s rational to defer to others. Recently, some authors have used such principles to argue for Evidential Uniqueness, the claim that for every batch of evidence, there’s a unique doxastic state that it’s permissible for subjects with that total evidence to have. This paper has two aims. The first aim is to assess these deference-based arguments for Evidential Uniqueness. I’ll show that these arguments only work given a particular kind (...) of deference principle, and I’ll argue that there are reasons to reject these kinds of principles. The second aim of this paper is to spell out what a plausible generalized deference principle looks like. I’ll start by offering a principled rationale for taking deference to constrain rational belief. Then I’ll flesh out the kind of deference principle suggested by this rationale. Finally, I’ll show that this principle is both more plausible and more general than the principles used in the deference-based arguments for Evidential Uniqueness. (shrink)

John Rawls’s articulation of what makes for justice in war includes one of his most interesting, yet least discussed, assessments of religion and state coercion. Rawls claims that “the duties of the statesman in political liberalism” are incompatible with adherence to “the Catholic doctrine of double effect” when that doctrine precludes the deliberate targeting of innocent and harmless human beings in a “supreme emergency.” I explicate Rawls’s argument in favor of that claim, articulate various theological objections, and assess some proposed (...) restrictions on the justificatory role of religious reasons in the light of that disagreement. In this article I address a number of central problems in modern and/or postmodern political and ethical life. I do so largely through an explication and comparison of John Dewey’s and Max Weber’s theoretical approaches and prescriptions for ethics and political participation. According to both Dewey and Weber, the modern world fragments both the ‘individual’ and ‘community’. This fragmentation impairs meaningful political action. Thus, the question becomes, how is the fragmentation on the individual and community level to be reconciled, coherence (...) regained and meaningful action restored? Dewey and Weber have conflicting answers to this set of questions. I argue that however wanting one might find Dewey and Weber’s insights, the questions and their insights are still relevant to this day. I argue that the problems brought on by modernity still flourish under ‘postmodern’ conditions. Further, I propose that given contemporary conditions (at least for some) a supplemented combination of Weber and Dewey’s views is the most suitable and politically efficient response to the demands of the day and would best serve our need for coherence and allow for meaningful political action. The article ends by proposing a blend of their views that is supplemented by the work of Judith Butler. (shrink)

At present there is an enormous discrepancy between our nanotechnological capabilities (particularly our nanobiotechnologies), our social wisdom, and consensus on how to apply them. To date, cost considerations have greatly constrained our application of nanotechnologies. However, novel advances in microsystem platform technologies are about to greatly diminish that economic constraint while developing new industries. Properly used in a solid legal and ethical framework, within an educated population, these advances will vastly enrich our quality of life without being intrusive. Improperly used, (...) these technologies could lead to a modern-day Luddism, social turmoil, or possibly even to emulating those societies described in the darkest of novels. These technologies must be developed in tandem with the social and legal frameworks needed to ensure that they improve both individuals and our society. To ensure that this occurs, we need to have the ethical, legal, scientific, and engineering experts working together and with the public. (shrink)

In Reasons and Persons, Parfit (1984) posed a challenge: provide a satisfying normative account that solves the Non-Identity Problem, avoids the Repugnant and Absurd Conclusions, and solves the Mere-Addition Paradox. In response, some have suggested that we look toward person-affecting views of morality for a solution. But the person-affecting views that have been offered so far have been unable to satisfy Parfit's four requirements, and these views have been subject to a number of independent complaints. This paper describes a person-affecting (...) account which meets Parfit's challenge. The account satisfies Parfit's four requirements, and avoids many of the criticisms that have been raised against person-affecting views. (shrink)

The SSIS SEL Brief Scales are multi-informant measures that were developed to efficiently assess the SEL competencies of school-age youth in the United States. Recently, the SSIS SELb was translated into multiple languages for use in a multi-site study across six European countries. The purpose of the current study was to examine concurrent and predictive evidence for the SEL Composite scores from the translated versions of the SSIS SELb Scales. Results indicated that SSIS SELb Composite scores demonstrated expected positive concurrent (...) and predictive relationships with scores from the Connor-Davidson Resilience Scale and negative relationships with scores from the problem behavior scales of the Strengths and Difficulties Questionnaire. Although there were a few exceptions, these patterns generally were consistent across informants and samples providing initial validity evidence for the Composite score from the translated versions of the SSIS SELb Scales. The words 'rebellion' and 'revolution' have gained renewed prominence in the vocabulary of world politics and so has the question of justifiable armed 'resistance'. In this book Christopher J. Finlay extends just war theory to provide a rigorous and systematic account of the right to resist oppression and of the forms of armed force it can justify. He specifies the circumstances in which rebels have the right to claim recognition as legitimate actors in revolutionary wars against domestic tyranny and (...) injustice, and wars of liberation against wrongful foreign occupation and colonialism. Arguing that violence is permissible only in a narrow range of cases, Finlay shows that the rules of engagement vary during and between different conflicts and explores the potential for irregular tactics to become justifiable, such as non-uniformed guerrillas and civilian disguise, the assassination of political leaders and regime officials, and the waging of terrorist war against civilian targets. Some theologians are inclined to regard realism with hostility or indifference. I do not present an argument for realism, but for why realism matters, and what is at stake.First of all, I separate the heart of realism from gratuitous doctrines which are too often associated with it. Religious realism is the claim that truth is independent of our beliefs about truth, and that we can in principle hope to have true beliefs about God. Realism is not intrinsically concerned with the (...) existence of ‘objects’, with natural theology or rational justification.I then show that even thinkers who are hostile or indifferent to religious realism so defined, usually make an implicit appeal to a similar realism in the sphere of ethics.To establish that realism matters in religion as well as ethics I draw an analogy with realism/anti‐realism about persons, to show that anti‐realism makes mutually risk‐taking and courageous relationships impossible. I go on to argue that far from it being a realist who is obsessed with rational certainty, this is one of the worst vices of the anti‐realist, who cannot bear there to be a gap between her beliefs and reality.I conclude that the most vital feature of religious realism is not certainty of belief, but the opposite – the acknowledged risk that all our hope could be in vain. In closing the possibility on this risk, the anti‐realist demonstrates an unfaithful and uncourageous movement of thought. (shrink)

This paper examines two mistakes regarding David Lewis’ Principal Principle that have appeared in the recent literature. These particular mistakes are worth looking at for several reasons: The thoughts that lead to these mistakes are natural ones, the principles that result from these mistakes are untenable, and these mistakes have led to significant misconceptions regarding the role of admissibility and time. After correcting these mistakes, the paper discusses the correct roles of time and admissibility. With these results in hand, the (...) paper concludes by showing that one way of formulating the chance–credence relation has a distinct advantage over its rivals. (shrink)

Kant actively struggles with the problem of how to conceive of God's creative action in relation to human freedom. He comes to the view that human freedom can only be protected if God withdraws in certain ways from the created world. The two pillars of Kant's mature philosophy - transcendental idealism and freedom - are in part shaped and motivated by Kant's need to provide a solution to his theological problem. The medieval and early modern theological tradition conceives of divine (...) action as unlike the action of any created being. When the creature acts, God directly causes this action, but without reducing the creature's freedom. Kant explicitly discusses and rejects this account of divine and human concursus. This rejection has significant and surprising ramifications for Kant's wider philosophy, explaining otherwise incomprehensible claims in his critical philosophy. Christopher J. Insole presents a definitive study in the history of ideas, engaging with a wide range of Kant's texts from 1749 until the early 1800s. Many of these texts have received little or no attention in Kant studies to date. Insole places Kant's thought in relation to numerous historical and traditional positions and illuminates these positions by a close engagement with recent debates in analytical philosophy and systematic theology. Kant is unrelentingly honest when grappling with the difficulty of relating divine and human freedom. This study, of Kant's theological struggle and legacy, goes to the heart of the problem in the modern reception of what the Christian tradition has affirmed about human freedom. As such, the book throws light on one of the defining fault-lines in modern theology and philosophy. (shrink)

Conditionalization is a widely endorsed rule for updating one’s beliefs. But a sea of complaints have been raised about it, including worries regarding how the rule handles error correction, changing desiderata of theory choice, evidence loss, self-locating beliefs, learning about new theories, and confirmation. In light of such worries, a number of authors have suggested replacing Conditionalization with a different rule — one that appeals to what I’ll call “ur-priors”. But different authors have understood the rule in different ways, and (...) these different understandings solve different problems. In this paper, I aim to map out the terrain regarding these issues. I survey the different problems that might motivate the adoption of such a rule, flesh out the different understandings of the rule that have been proposed, and assess their pros and cons. I conclude by suggesting that one particular batch of proposals, proposals that appeal to what I’ll call “loaded evidential standards”, are especially promising. (shrink)

I argue that the theory of chance proposed by David Lewis has three problems: (i) it is time asymmetric in a manner incompatible with some of the chance theories of physics, (ii) it is incompatible with statistical mechanical chances, and (iii) the content of Lewis's Principal Principle depends on how admissibility is cashed out, but there is no agreement as to what admissible evidence should be. I proposes two modifications of Lewis's theory which resolve these difficulties. I conclude by tentatively (...) proposing a third modification of Lewis's theory, one which explains many of the common features shared by the chance theories of physics. (shrink)

This article proposes an empirical approach to understanding the life of an organism that overcomes reductionist and dualist approaches. The approach is based on Immanuel Kant’s analysis of the cognitive conditions required for the recognition of an organism: the concept of teleology and the assumption of a formative power of self-generation. It is analyzed how these two criteria are applied in the cognition of a developing organism. Using the example of a developmental series of a plant leaf, an active and (...) relational process between observer and developing organism is shown, within which the teleology and self-generating power of the organism can be empirically observed through the mental faculties of understanding and will. Furthermore, it is emphasized that, according to Kant, even physical objects are not readily given, but are actively constituted through the unification of sense perceptions with concepts. This Kantian mode of objectification facilitates cognition of the physical properties of an organism. It can be supplemented with a participatory and co-constitutive mode of realization, in which the life of the organism (its teleologically organizing and self-generating power) can become an object of empirical research. Furthermore, it is argued that the participatory mode also facilitates an expanded conception of nature that allows for the existence of living beings within it. Finally, an analogy to Goethe’s approach to the living organism is highlighted. In summary, it is stated that to understand life, one must consciously participate in it. (shrink)

The figure of Richard Rorty stands in complex relation to the tradition of American pragmatism. On the one hand, his intellectual creativity, lively prose, and bridge-building fueled the contemporary resurgence of pragmatism. On the other, his polemical claims and selective interpretations function as a negative, fixed pole against which thinkers of all stripes define themselves. Virtually all pragmatists on the contemporary scene, whether classical or "new," Deweyan, Jamesian, or Peircean, use Rorty as a foil to justify their positions. The resulting (...) internecine quarrels and divisions threaten to thwart and fragment the tradition's creative potential. More caricatured than understood, the specter of Rorty is blocking the road of inquiry and future development of pragmatism. Reconstructing Pragmatism moves beyond the Rortyan impasse by providing what has been missing for decades: a constructive, non-polemical account of Rorty's relation to classical pragmatism. The first book-length treatment of Rorty's intellectual debt to the early pragmatists, it establishes his selective appropriations not as misunderstandings or distortions but as a sustained, intentional effort to reconstruct their thinking. Featuring chapters devoted to five key pragmatist thinkers - Peirce, James, Dewey, Royce, and Addams - the book draws on archival sources and the full scope of Rorty's writings to challenge prevailing misconceptions and caricatures. By illuminating the critical resources, still largely untapped, that Rorty offers for articulating classical pragmatism's ongoing relevance, the book reveals limitations in the received images of the classical pragmatists that predominate in current debates and opens up new modes of understanding pragmatism and why it matters today. As there is currently a neo-Aristotelian revival currently taking place within contemporary metaphysics and dispositions, or causal powers are now being routinely utilised in theories of causality and modality, more attention is beginning to be paid to a central Aristotelian concern: the metaphysics of substantial unity, and the doctrine of hylomorphism. In this paper, I distinguish two strands of hylomorphism present in the contemporary literature and argue that not only does each engender unique conceptual difficulties, but neither adequately captures the (...) metaphysics of Aristotelian hylomorphism. Thus both strands of contemporary hylomorphism, I argue, fundamentally misunderstand what substantial unity amounts to in the hylomorphic framework – namely, the metaphysical inseparability of matter and form. In “Bayesianism, Infinite Decisions, and Binding”, Arntzenius et al. (Mind 113:251–283, 2004 ) present cases in which agents who cannot bind themselves are driven by standard decision theory to choose sequences of actions with disastrous consequences. They defend standard decision theory by arguing that if a decision rule leads agents to disaster only when they cannot bind themselves, this should not be taken to be a mark against the decision rule. I show that this claim has surprising implications for a (...) number of other debates in decision theory. I then assess the plausibility of this claim, and suggest that it should be rejected. The rapid rise in interest in geoengineering the climate as a response to global warming presents a clear and significant challenge to environmental ethics. The paper articulates what I call the 'presumptive argument' against geoengineering from environmental ethics, a presumption strong enough to make geoengineering almost 'unthinkable' from within that tradition. Two rationales for suspending that presumption are next considered. One of them is a 'lesser evil' argument, the other makes connections between the presumptive argument, ecofacism, and the anthropocentrism/non-anthropocentrism debate. (...) The discussion is designed to prompt reflection on how environmental ethicists should orient themselves to the rapidly moving geoengineering debate and what they should think about the moral significance of the earth's large-scale biogeochemical processes compared to the moral significance of individuals, species, and ecosystems. At the heart of the Bayesianism is a rule, Conditionalization, which tells us how to update our beliefs. Typical formulations of this rule are underspecified. This paper considers how, exactly, this rule should be formulated. It focuses on three issues: when a subject’s evidence is received, whether the rule prescribes sequential or interval updates, and whether the rule is narrow or wide scope. After examining these issues, it argues that there are two distinct and equally viable versions of Conditionalization to (...) choose from. And which version we choose has interesting ramifications, bearing on issues such as whether Conditionalization can handle continuous evidence, and whether Jeffrey Conditionalization is really a generalization of Conditionalization. Standard decision theory has trouble handling cases involving acts without finite expected values. This paper has two aims. First, building on earlier work by Colyvan (2008), Easwaran (2014), and Lauwers and Vallentyne (2016), it develops a proposal for dealing with such cases, Difference Minimizing Theory. Difference Minimizing Theory provides satisfactory verdicts in a broader range of cases than its predecessors. And it vindicates two highly plausible principles of standard decision theory, Stochastic Equivalence and Stochastic Dominance. The second aim is to (...) assess some recent arguments against Stochastic Equivalence and Stochastic Dominance. If successful, these arguments refute Difference Minimizing Theory. Although they are continually compositionally reconstituted and reconfigured, organisms nonetheless persist as ontologically unified beings over time – but in virtue of what? A common answer is: in virtue of their continued possession of the capacity for morphological invariance which persists through, and in spite of, their mereological alteration. While we acknowledge that organisms‟ capacity for the “stability of form” – homeostasis - is an important aspect of their diachronic unity, we argue that this capacity is derived from, and grounded (...) in a more primitive one – namely, the homeodynamic capacity for the “specified variation of form”. In introducing a novel type of causal power – a „structural power‟ – we claim that it is the persistence of their dynamic potential to produce a specified series of structurally adaptive morphologies which grounds organisms‟ privileged status as metaphysically “one over many” over time. This introductory survey offers the student a clear, accessible interpretation and synthesis of the social thought of these historically significant thinkers. Organised thematically, it takes the student through their accounts of social institutions, their critique of individualism, their methodology, their views of progress and of moral and cultural values.
